1. Acceptance of Terms

By accessing and using EnsayoHub's services, you accept and agree to be bound by the terms and provision of this agreement.

2. Description of Service

EnsayoHub is an AI-powered fitness application that provides personalized workout programs for strength training and combat sports including Muay Thai, Kickboxing, and Boxing.

3. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

4. Subscription and Payment

4.1 Subscription Options

EnsayoHub offers auto-renewing subscription options that provide access to premium features and personalized AI-powered fitness programs. Subscription details, including the title of each subscription, duration, and pricing, are displayed within the app at the time of purchase.

4.2 Auto-Renewal

Your subscription will automatically renew unless canceled at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of your selected subscription plan.

4.3 Payment Processing (Apple App Store)

If you purchase a subscription through the Apple App Store, payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions are managed through your Apple ID Account Settings. EnsayoHub does not have access to your payment card details; all payment processing is handled by Apple.

4.4 Payment Processing (Google Play Store)

If you purchase a subscription through the Google Play Store, payment will be charged to your Google Play account at confirmation of purchase. Subscriptions are managed through your Google Play Store Settings. EnsayoHub does not have access to your payment card details; all payment processing is handled by Google.

4.5 Managing Your Subscription

You can manage or cancel your subscription at any time through your device settings after purchase. To cancel, you must turn off auto-renewal at least 24 hours before the end of the current billing period.

4.6 Limited Premium Access

New users receive Limited Premium access for 14 days (or 45 days with a valid referral code) upon registration. During this period, users have access to all premium features. After the Limited Premium period expires, users transition to Limited Access, which provides core workout functionality but restricts certain premium features such as:

  • Martial Arts training (Boxing, Kickboxing, Muay Thai)
  • Weekly AI Coach Check-ins and Progressive Coaching
  • Advanced Muscle Group Targeting
  • Health Condition Customization
  • Short workout durations (15-30 minutes)
  • Weight Progress Tracking Charts

Any unused portion of the Limited Premium period will be forfeited when you purchase a subscription, and the subscription duration will be added to your current expiration date.

4.7 Refunds

Subscription fees are non-refundable except as required by applicable law. For purchases made through the Apple App Store, refund requests must be directed to Apple. For purchases made through the Google Play Store, refund requests must be directed to Google. Both are handled in accordance with their respective policies.

5. Account Deletion

You may request deletion of your account and associated data at any time through the app's Account settings. Upon account deletion, your personal data will be permanently removed from our systems in accordance with our Privacy Policy. Note that deleting your account does not automatically cancel any active subscriptions; you must cancel your subscription separately through Apple or Google before deleting your account to avoid future charges.

6. Health and Safety

Before beginning any exercise program, consult with your physician. EnsayoHub is not responsible for any injuries that may occur during the use of our fitness programs.

7. Intellectual Property

All content, features, and functionality of EnsayoHub are owned by EnsayoHub and are protected by international copyright, trademark, and other intellectual property laws.

8. Prohibited Uses

You may not use our service for any unlawful purpose or to solicit others to perform unlawful acts, violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.

9. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever.

10. Limitation of Liability

In no case shall EnsayoHub be liable for any incidental, special, exemplary, or consequential damages arising out of or in connection with your use of the service.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the application.

13. License Scope

Subject to your compliance with these Terms of Service, EnsayoHub grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the application on devices that you own or control, as permitted by the applicable app store's terms. This license does not allow you to use the application on any device that you do not own or control.

14. Legal Compliance

You represent and warrant that:

  • You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
  • You are not listed on any U.S. Government list of prohibited or restricted parties.

15. Apple App Store Additional Terms

If you downloaded EnsayoHub from the Apple App Store, you acknowledge and agree that:

  • These Terms of Service are between you and EnsayoHub only, and not with Apple Inc. ("Apple"). EnsayoHub, not Apple, is solely responsible for the EnsayoHub app and its content.
  • Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.
  • Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
  • In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms of Service, and upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Service against you as a third-party beneficiary thereof.
  • You must comply with applicable third-party terms of agreement when using the app (e.g., your wireless data service agreement).

16. Google Play Store Additional Terms

If you downloaded EnsayoHub from the Google Play Store, you acknowledge and agree that:

  • These Terms of Service are between you and EnsayoHub only, and not with Google LLC ("Google"). EnsayoHub, not Google, is solely responsible for the EnsayoHub app and its content.
  • Google has no obligation to furnish any maintenance and support services with respect to the app.
  • Google is not responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app.
  • In the event of any third-party claim that the app infringes that third party's intellectual property rights, Google will not be responsible for the investigation, defense, settlement, and discharge of any such claim.
  • You must comply with applicable third-party terms of agreement when using the app.
